A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
No one shall trade marijuana, except where approved by the Minister of Food and Drug Safety, and smoke it except where he/she smokes it for medical purposes with approval from the Minister of Food and Drug Safety.
1. On November 16, 2019, around 18:14, 2019, the Defendant: (a) decided to purchase marijuana from a hemp seller using the conversations called “B” (hereinafter “B”); (b) transferred KRW 1.60,000 to a corporate bank account in the name of D (E) designated by B from his agricultural bank account (C); and (c) brought about approximately 1.6g marijuana in Gwangju Metropolitan City, a place known to B; and (d) from then on seven occasions until January 31, 2020, the Defendant sent each account entered “B” in each column of “the date and time” as indicated in the list of crimes in the separate sheet, and then brought about each “the amount of marijuana” recorded in “B” at each place designated by B, where B was known.
Accordingly, the defendant, without obtaining approval from the Minister of Food and Drug Safety, sold a total of 940,00 won of marijuana (a total of 9.4g amount).
2. On November 16, 2019, the Defendant: (a) purchased marijuana as referred to in the foregoing paragraph (1) around 18:14; (b) purchased it in the Defendant’s residence located in Gwangju mine area F at a time within one hour from that time; (c) in the Defendant’s residence located in Gwangju mine area, she puts it into the Defendant’s water in the plastic box, she puts it into the Defendant’s water, and she puts it into the Defendant’s live-water disease, and she puts it into the Defendant’s live-water disease, she puts it into the Defendant’s live-water disease at the entrance of that aquatic disease and puts it into the Defendant’s live-water disease at a point of time within one hour; and (d) purchased it at each time on seven occasions in total by January 31, 2020 in the column of “day” in the annexed Table of Crimes:
