A defendant shall be punished by imprisonment for not less than eight months.
Provided, That the execution of the above punishment shall be suspended for two years from the date this judgment became final.
Punishment of the crime
1. Around October 2017, the Defendant made a false statement to the effect that “The Defendant would jointly purchase the victim E at a foreign direct outlet in the vicinity of the C Library located in Gwangju Northern-gu Seoul Northern-gu.”
However, the defendant did not have any intention or ability to purchase the above goods in a foreign direct area.
On October 20, 2017, the Defendant acquired 590,000 won, including KRW 300,000,000 from the victim, and KRW 290,000,00 from October 27, 2017, from the victim to the F bank account in the name of the Defendant.
2. Around December 2017, the Defendant made a false statement to the effect that “The Defendant, as a deposit for the investment purpose of the FF Bank, is entitled to lend money to the victim’s home located in the Seoul branch of the F Bank Seoul branch office of the F Bank, which would allow the F Bank to make an investment in the name of the F Bank’s VIP customer, and would enable the F Bank to receive a high interest rate of KRW 1.5 million per month.”
However, the defendant did not think that he would deposit the money received from the victim, and there was no intention or ability to pay the agreed interest to the victim.
On December 12, 2017, the Defendant acquired 48,000,000 won, including the sum of 6,000,000 won, 4,000,000 won around January 16, 2018, and 10,000 won around March 14, 2018, and 10,000,000 won around March 15, 2018, and 10,000 won around March 18, 2018, and 10,000,000 won around March 18, 2018, and 8,000,000 won around March 21, 2018, from the Defendant’s account under the name of the Defendant.
3. However, the defendant receives money from the victim in Japan.
