B. According to the fact of recognition of liability, the defendant is liable for damages suffered by the plaintiffs, who are the deceased and their bereaved family members, as mutual aid business operators of the defendant vehicle.
C. The defendant asserts that since the accident of this case occurred due to the total negligence of the deceased who was frighting in the central line at night, the driver of the defendant vehicle must be exempted from liability.
In general, it is common for the vehicle driver who operates a road with a central line installed along his own lane to trust the vehicle to be operated along the upper line. Therefore, the other party is obliged to take special measures by forecasting the center line of the road until it reaches the center line.
