Reasons

1. Basic facts

A. The registration of ownership transfer was completed in the name of the Defendant or the target becco corporation (hereinafter “Nonindicted Co., Ltd.”) as follows with respect to the instant real estate, which was owned by Samsung Electronic Co., Ltd. (hereinafter “Tsung Electronic”) before the ownership transfer of the storage sites and storage facilities for the Busan Geum-gu B, C, and D (hereinafter “instant real estate”).

1) 4067m2 (hereinafter “B real estate”) for warehouse B in the Geum-gu, Busan (hereinafter “B”).

(2) On June 11, 2015, the ownership transfer registration for the portion of B 2644.52/4067 shares was completed on the ground of sale on November 13, 2014 in the Defendant’s future. On June 11, 2015, the ownership transfer registration for the remainder of 142.48/4067 shares was completed on the non-party company’s future on May 15, 2015; thereafter, B real estate was divided into “B warehouse site 264.6 square meters” and “142.4 square meters in the E warehouse site 264.6 square meters; accordingly, the ownership transfer registration for the non-party company’s share was completed on the ground of sale on the non-party company’s remaining portion of B warehouse site 2644.6 square meters, and the ownership transfer registration for the non-party company’s share was completed on the ground of the non-party company’s share 265 square meters on July 17, 2015015.

B. 1) The process of acquiring the ownership of the remaining real estate, etc. of the non-party company was originally concluded on November 13, 2014 between Samsung Electronic and the defendant, but the non-party company succeeded to the status of the purchaser and acquired the ownership of the remaining real estate (for this purpose, between the defendant and the non-party company on March 17, 2015, the defendant provided the non-party company with advice, guidance, and advice on all real estate issues that may arise to the non-party company in relation to the purchase of the instant real estate, and the non-party company.
