In full view of the purport of the entire argument in Gap evidence No. 1 as to the cause of claim, the plaintiff lent KRW 34 million to the defendant before several years, and the defendant prepared and issued a certificate to the plaintiff on June 25, 2019 that he/she will pay the plaintiff KRW 34 million up to December 31, 2019. According to the above facts of recognition, the defendant is obligated to pay to the plaintiff 34 million and damages for delay calculated at the rate of 5% per annum as prescribed by the Civil Act from January 1, 2020 to February 10, 2020 where the copy of the complaint of this case was delivered to the defendant from January 1, 2020 to February 10, 2020, and the next day to the day of full payment by 12% per annum as prescribed by the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings.
2. It is so decided as per Disposition by the assent of all participating Justices on the ground that the plaintiff's claim of this case is reasonable.
