1. The Defendant’s KRW 23,170,865 to Plaintiff A and its related costs from August 27, 2015, and KRW 21,739,780 to Plaintiff B and its related costs.
1. The following facts are recognized in addition to the statement in Gap evidence No. 1:
A. The Plaintiffs, employed by the Defendant, work for the Plaintiff A from February 25, 2013 to August 12, 2015, and Plaintiff B from September 5, 2012 to August 9, 2015, respectively.
The retirement was made.
B. The Defendant did not pay the Plaintiff A wages and retirement allowances of KRW 23,170,865, and KRW 21,739,780, respectively, to the Plaintiff B.
2. According to the above facts, the Defendant is obligated to pay the Plaintiff 23,170,865 won due to unpaid wages and retirement allowances, and to pay damages for delay calculated at the rate of 20% per annum from August 27, 2015, the day following the day on which the obligation to pay retirement allowances arises to the Plaintiff B, and from August 24, 2015, the day following the day on which the obligation to pay retirement allowances arises to the Plaintiff B, and from August 24, 2015 to the day of full payment.
Therefore, each of the claims of the plaintiffs in this case is justified and it is so decided as per Disposition by the assent of all participating Justices.
