The defendant's appeal is dismissed.
1. The summary of the grounds for appeal did not err by misapprehending the facts charged, and thereby adversely affecting the conclusion of the judgment, even though the Defendant did not violate the signal, since it proceeded with the intersection line.
2. In full view of the testimony of the witness C and the evidence duly adopted and examined by the court below that controlled the instant offense, the court below's judgment that found the Defendant guilty of the instant facts charged that the Defendant violated the signal, is justified, and there is no error of misconception of the facts pointed out by the Defendant.
3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the defendant's appeal is without merit.
