The prosecutor's appeal is dismissed.
1. Summary of the grounds for appeal and the sentencing and police officer (in cases of original trial, four months of imprisonment, one year of suspended execution, and 80 hours of community service);
2. The Prosecutor’s argument that the Defendant’s liability is heavy in light of the background and method of the instant crime, the amount of damage, etc. is correct.
However, in full view of the facts that the defendant led to the crime of this case, and that there was no record of punishment exceeding the same kind of punishment or fine in the past, etc., the court below's determination of punishment can be acceptable, and it does not mean that the prosecutor asserts it.
3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act as it is without merit. It is so decided as per Disposition.
