2. Applicable provisions of Acts: Judgment without pleadings (Articles 208 (3) 1 and 257 of the Civil Procedure Act);

3. A lawsuit seeking the return of the deposit for lease without delivery of a leasehold building with the reason for dismissing a partial claim shall be deemed to constitute a lawsuit for future performance, and thus, the statutory interest rate prescribed in the Act on Special Cases concerning Expedition, etc. of Legal Proceedings shall be excluded pursuant to the proviso to Article 3 (1) of the same Act.
