[2016 Highest 2932 / [2016 Highest 2932] The Defendant entered into an entrusted operation contract with the victim C, and has been engaged in the management of “E” on the D1st floor in Seoul Special Metropolitan City, Nowon-gu from October 9, 2015, and “G” in Seoul F from February 1, 2016 to February 1, 2016.

1. While attracting new customers and opening of a mobile phone device, the Defendant embezzled the mobile phone purchaser at will, on December 10, 2015, using a mobile phone device from the victim company for the purpose of business keeping the name on behalf of the victim company, and then arbitrarily disposed of and embezzled the mobile phone device owned by the victim company in total of 32 large market prices from 29,04,40 won, including a mobile phone device owned by the victim company in total, including a mobile phone 6S, a gallon ju, a gallon 5, a gallon ju, and a gallon ju, a gallon ju, without opening through an opening process, from around that time to March 2016.

Around January 30, 2016, the Defendant embezzled KRW 25,032,646 arbitrarily consumed and embezzled the sum of KRW 25,032,646, as shown in attached Table 2, from around that time to March 16, 2016, as in attached Table 2, while paying a sum of KRW 566,00 from the customer H to the victim’s business custody on behalf of the victim company, without depositing in the victim company.

[2016 Highest 3249] The Defendant, while operating a mobile phone agency, used personal information known to him/her through the opening of the mobile phone, intended to enter a mobile phone in another person’s name and receive fees from the radio operator and obtain money from the radio operator.
