A. The parties concerned 1) The Defendant is a school foundation that establishes and operates C University. The Plaintiff was appointed as C University faculty member on March 1, 200 and currently in office as C University D major faculty member on March 1, 2000. 2) C University was selected as a business operator of the Korea Industrial Complex Development Institute (former Ministry of Knowledge Economy) and a regional innovation center project that the Korea Institute support and supervises, and established C University Specialization Center for Industrial Technology Protection (hereinafter “instant center”) around July 2008. The Plaintiff served as the director of the instant center from July 1, 2008 to December 10, 2012.

B. 1) On July 1, 2008, the Korea Institute for Advancement of Technology assessed the current status of the instant center’s business from July 1, 2008 to June 201. The instant center was assessed as 60.75 points for its business from July 2008 to June 201, and as 62.2 points for its business from July 2010 to February 2012, the Korea Institute for Advancement of Technology (hereinafter referred to as the “Korea Institute for Advancement”) was assessed as 60 points for its business, and received 60 points, which are the minimum points for its continuous business. (2) On August 8, 2012, the Korea Institute for Advancement of Technology (hereinafter referred to as the “Korea Institute for Advancement”) conducted on the instant center, an on-site investigation and comprehensive assessment, and as a result of the comprehensive assessment on November 26, 2012, it notified the Plaintiff that it may continue its business on condition that it will replace the Plaintiff, a general manager.

3) Accordingly, the Plaintiff retired from office and recommended E as a subsequent warden. On December 11, 2012, E had obtained approval from the Korea Institute for Advancement of Technology and served as the president of the instant center from around that time. 4) The Korea Institute for Advancement of Technology has conducted an annual evaluation of the instant center’s business from March 1, 2012 to February 28, 2013, and on April 11, 2013, the instant Center had conducted an annual evaluation of its business from March 1, 2012 to February 28, 2013.
