A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.
Punishment of the crime
1. Crimes committed from September 9, 2014 to September 11, 2014;
A. On September 22, 2014, the Defendant violated the Act on the Punishment of Arrangement of Commercial Sex Acts, Etc. (the Act on the Punishment of Arrangement of Commercial Sex Acts, Etc.) caused E, who is an employee, to engage in a similar act by taking care of the sexual organ of the said customer in return for the payment of KRW 70,000 from male customers.
In addition, from September 9, 2014 to September 11, 2014, the Defendant arranged commercial sex acts by raising profits equivalent to the average cost of KRW 400,000 per day by allowing employees, such as E and F, employed by the Defendant, to perform the similarity act in return for the price of KRW 6-70,000 from customers by the said method as above.
B. The Defendant violating the School Health Act
At the same time in the school environmental sanitation and cleanup zone, the above businesses are likely to be conducted with physical contacts or similarity.
2. Crimes committed from October 24, 2014 to October 30, 2014;
A. On October 24, 2014, the Defendant violated the Act on the Punishment of Arrangement of Commercial Sex Acts, Etc. (the Act on the Punishment of Arrangement of Commercial Sex Acts, Etc.) (the act of arranging commercial sex acts) and closed his/her temporary business place, which was controlled by the police, and started his/her business by again
At around 20:10 on October 30, 2014, the Defendant: (a) received 70,000 won from a person whose customer’s name is unknown; and (b) had a single-name “G”, an employee, wrap the sexual organ of the said customer in his/her hand, and wrap the said customer into a similar assistant act.
In addition, the Defendant, from October 24, 2014 to October 30, 2014, had employees, such as the name “G”, “H”, and “I,” employed by the Defendant perform the similarity act in return for the payment of KRW 6-70,00 from customers by the said method as above. The Defendant amounted to KRW 400,00 per day.
