Each of the crimes of this case is an unfavorable circumstance, where each of the crimes of this case was committed by the Defendant, who was sentenced to imprisonment with prison labor for a period of ten years on October 26, 2006, and committed each of the crimes of this case at least four days after release and four days after release, in order to establish the state’s legal order and to eradicate a light view of public authority. On the other hand, the fact that the defendant acknowledges each of the crimes of this case and reflects his mistake, that the above victim did not want the punishment against the defendant, and that part of the damaged public goods appears to have been replaced at the expense of the defendant, and that the defendant did not repeat the crime.

In full view of the above circumstances and all other factors of sentencing as indicated in the pleadings of this case, including the Defendant’s age, sex, environment, family relationship, motive for committing a crime, means and consequence of a crime, etc., the sentence imposed by the lower court is too uneasy and unreasonable.

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the prosecutor's appeal is without merit. It is so decided as per Disposition.
