The defendant shall be innocent.
Reasons
1. At around 15:39 on April 16, 1997, A, the Defendant’s user, loaded and operated a waste scrap metal in the shape of 12 tons exceeding 10 ton of the limitation 10 ton of the limitation 10 ton of the limitation 10 ton of the 3 axis of the above vehicle.
2. Article 86 of the former Road Act (amended by Act No. 4920 of Jan. 5, 1995, and amended by Act No. 7832 of Dec. 30, 2005) which applies to a summary order subject to review, has retroactively lost its effect in accordance with the Constitutional Court’s decision of unconstitutionality (amended by Act No. 7832 of Dec. 30, 2005). Thus, the Defendant is acquitted under the former part of Article 325 of the Criminal Procedure Act
