The defendant shall pay 86,121,024 won to the plaintiff and 12% per annum from July 18, 2020 to the day of complete payment.
Although the Plaintiff supplied a steel plate, etc. to the Defendant, the remainder of KRW 86,121,024, which was paid only a part of the price of the above goods, is not disputed between the parties, or the entire purport of the pleadings can be comprehensively acknowledged. Accordingly, the Defendant is liable to pay to the Plaintiff damages for delay calculated at the rate of 12% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings, etc. from July 18, 2020 to the day of full payment after the original copy of the instant payment order was served to the Plaintiff.
Therefore, the plaintiff's claim of this case is justified and it is so decided as per Disposition.
