피고인은 중국에 있는 이른바 ‘ 보이스 피 싱’ 조직원인 성명 불상자( 일명 ‘E’ )로부터 ‘ 위 챗 (we chat)' 이라는 채팅 어 플 리 케이 션을 통해 실시간으로 지시를 받아 보이스 피 싱 범행에 사용될 계좌에 연결된 체크카드를 모집하고, 그 계좌에 입금된 돈을 인출하고, 이를 다시 중국에 있는 조직원에게 송금하는 역할을 하는 체크카드 모집 및 인출 책으로서, 위 성명 불상자 등 보이스 피 싱 조직원들과 함께 국내 불특정 다수 피해자들의 컴퓨터에 악성 코드를 설치하여 계좌 정보 등을 알아내거나 피해자들을 상대로 거짓말을 하여 위와 같이 모집한 계좌로 돈을 송금 받아 편취하기로 공모하였다.
