A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
1. At around 04:00 on April 24, 2013, the Defendant, at the victim D’s house located in Dongdaemun-gu Seoul Metropolitan Government C underground 102, took alcohol with the victim, and then stolen the victim’s possession of one 90,000 won or more of the market price owned by the victim, which is equivalent to the sum of 2,000,000 won or more of the market price, 5,000,000 won or more of the market price, 20,000 won in cash, identification card, and 2,000,000 won in the market price.
2. On April 24, 2013, the Defendant violated the Fraud and the Specialized Credit Finance Business Act: (a) presented the above e-mail card, which was a stolen debit card, to the employees of the said convenience store, whose name is not known at the session of G convenience store in Dongdaemun-gu Seoul, Seoul, and (b) obtained the above e-mail card, which was a debit card, from the employees, and acquired it by fraud; (c) made the victim prepare the sales slip, signed it on the signature column, and used the stolen debit card; and (d) obtained the goods totaling of KRW 393,200 from the employees on eight occasions in total as indicated in the following crime list, and acquired it by fraud, and used the stolen debit card.
