1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
1. Basic facts
A. The Plaintiff’s entrusted management 1) The Plaintiff is a person who operates “C” under the name of D with respect to a personal business entity managing the building. The Plaintiff is a stock company E on February 29, 2012 (hereinafter “E”).
According to the Supreme Court’s registration record inspection service for aggregate buildings with 10 stories underground in F and 10 stories above ground in Namyang-si, Namyang-si, the registration of preservation of ownership for each section of exclusive ownership is likely to have been completed on September 11, 2006 under E. G (hereinafter “G”).
A) A contract for the entrusted management of a building was concluded. The Plaintiff, as a guarantor of E and C on the date of the contract, prepared a contract for the entrusted management of a building that contains the following contents. Article 3 (Contract Period and Method of Payment of Management Expenses):
1. The term of a contract shall be from March 1, 2012 to February 28, 2017;
2. A coordination may be made after consultation one month prior to the occurrence of factors to increase service costs due to price inflation after the lapse of one year from the commencement of business;
3. Monthly management expenses shall be 3,500 won per 3.3 square meter of the sale area, and shall be paid by the end of each month.
(E) A part of the tax may be increased or decreased after consultation with subparagraph (C). Article 6 (Methods of Collecting Service Expenses and Management Expenses)
1. The electricity and water supply charges, out of service costs, shall be notified after weighing;
2. The electricity and water rates shall be collected including the imposition of management expenses, but shall not be obliged to pay them if they are not paid in full due to the account receivable.
3. Eul shall keep and operate the management expenses of players on a 3.3 square meter per 3 square meter by imposing them on the user, and shall mutually take over and transfer them to the prior resident at the time of eviction.
Article 10 (Methods of Collecting Management Expenses and Imposing Overdue Charges)
1. General management expenses: 3,500 won per deliberation (part of four floors, 3,00 won for reduction of nine floors, 3,000 won) and reserve for special repair;
2. Expenses for building management: Separate imposition.
3. Electricity rates and water rates: Separate imposition;
4. The arrears of management expenses shall be in accordance with the following table:
(Omission) Article 28 (Matters of Special Agreement) The provisions of this Special Agreement shall prevail in all the terms and conditions of the Agreement.
1. The management expenses for the factory rooms owned by A shall be all.
