The prosecutor's appeal is dismissed.
1. According to the detailed and consistent statements made by the victim and CCTV images supporting this, the fact that the defendant committed an indecent act by exposing his/her hands outside his/her cell phone from subway escalators is recognized.
2. However, the lower court found the Defendant not guilty of the facts charged of this case in its detailed statement of the grounds for its determination. Examining the evidence duly admitted and examined by the lower court in light of the records, the evidence alone presented by the prosecutor was proven without any reasonable doubt.
Therefore, the judgment of the court below which acquitted the public prosecutor of the facts charged of this case is just, and there is no error of law as alleged by the public prosecutor.
3. In conclusion, the prosecutor's appeal is dismissed. It is so decided as per Disposition.
