1. The plaintiff's appeal is dismissed.
2. The costs of appeal shall be borne by the Plaintiff.
The purport of the claim and appeal is the purport of the appeal.
1. (1) On August 28, 1998, the Plaintiff entered into an accident insurance contract with the Defendant on the basis of the following: (a) from August 28, 1998 to August 28, 2018, the period of insurance was from August 28, 1998 to the insured and the beneficiary of injury, and (b) the insured and the beneficiary are receiving the insurance money if they suffer disability due to a disaster other than a traffic accident that occurred on the ordinary day.
(2) According to the insurance contract of this case, the defendant is obliged to pay insurance proceeds to beneficiaries as follows when the insured becomes a disability specified in the attached Table 5 of the Clause of this case (Grade 1 through 6; hereinafter referred to as the “instant disability classification table”) due to a traffic disaster other than usual days during the insurance period.
Grade 1 and Grade 2: (a) With respect to the amount of monthly insurance benefits, the amount of ordinary daily disability benefits of KRW 2.5 million or KRW 1.5 million or KRW 1.5 million or KRW 2.5 million or KRW 2.5 million or KRW 3) The relevant part of the instant disability classification table is as follows; (b) according to Article 14(5) of the terms of the instant insurance contract, where the insured has suffered at least two obstacles due to the same disaster during the insurance period, the amount of disability pension or disability benefits corresponding thereto shall be paid to the beneficiary, respectively.
Grade II of the physical disability of the class;
1. Where he/she is required to have a serious obstacle to his/her old age, old age, alert or mental health and to receive occasional nursing;
2. When he/she is required to receive occasional nursing because he/she has left a chest or long-term disability;
3. Where it becomes impossible to use one arms and one bridge completely;
4. Where he/she has lost ten fingers or has become unable to use them permanently;
5. Grade III, among one arms and one bridge, in which physical disabilities in Grades III through VII have occurred.
