그러나 사실은 피고인은 피해자를 속여 물품대금만 송금 받아 사용할 생각이었고 위 ‘ 우경 섶 다리 ’를 가지고 있지 않았기 때문에 피해 자로부터 물품대금을 송금 받더라도 피해자에게 위 ‘ 우경 섶 다리 ’를 보내줄 의사나 능력이 없었다.
