강제추행
The defendant shall be innocent.
1. On January 15, 2018, the Defendant, at around 19:30, committed an indecent act by force against the victim C (the 26-year-old age), who was an employee of the Defendant, during the camcing procedure in the camcling room in the camcling room in the Bupyeong-gu Incheon Metropolitan City, in order to remove the Defendant’s sexual organ from the Defendant’s sexual organ. 2. According to the evidence duly examined and adopted by this court, the following facts are acknowledged.
① The Defendant received approximately 1 hour and 30 minutes of a cream surgery from the victim; the victim saw the Defendant’s sound, resistance, etc. using a hair cream, etc.; and lastly, in the process of the Defendant’s creaming on the Defendant’s sound, etc., the Defendant changed his/her cream to the victim, and the Defendant was also aware of his/her creaming on his/her own on the part of the victim; and as such, in the process of his/her creaming the cream, the fixed amount was filled by the Defendant’s circumstance in his/her hands.
② In the statement of the police, the victim stated that, after having the Defendant knife the Defendant’s sexual organ by taking the Defendant’s hand, the Defendant knife the Defendant’s sexual organ and knife the Defendant’s hand, the victim made a statement in this court that, however, it is not clear that the Defendant was unable to clearly memory whether or not the Defendant knife the victim’s hand, and the Defendant committed a self-defense act, but the Defendant did not make the Defendant knife the Defendant’s sexual organ.
③ At the time of the Defendant’s performance of the marry operation as above, the Defendant continued to have her body in the state of her body, and the victim took the marry operation at the location of leaving the Defendant back from the Defendant’s side, and the said place is located.
