1. The Defendant shall pay to the Plaintiff KRW 182,134,850 and the interest rate of KRW 12% per annum from June 21, 2019 to the date of full payment.
1. From August 1, 2014 to June 2016, the Plaintiff: (a) supplied disturbance to the Defendant’s representative director C; and (b) from June 2016 to September 2017 to the Defendant, the Plaintiff supplied disturbance to the Defendant; and (c) the value of supply is KRW 182,134,850.
The defendant does not pay the money to the plaintiff even after confirming the amount of the unpaid goods.
Therefore, the defendant shall pay to the plaintiff the price for the goods 182,134,850 won and damages for delay from the day following the day on which the plaintiff seeks payment by serving a copy of the complaint of this case.
2. Judgment without holding any pleadings (Articles 208 (3) 1 and 257 (1) of the Civil Procedure Act);
3. Since the interest rate under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings for Partial Dismissal is changed to 12% per annum from June 1, 2019 (see the provisions on statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings), part of the claim seeking damages for delay by 15% per annum is dismissed.
