피고인은 2015. 11. 24. 03:20 경 경기 연천군 C에 있는 D 노래 연습장 복도에서, 다른 손님인 피해자 E(49 세) 이 피고인의 일행과 어깨가 부딪힌 것을 빌미로 피해자 E에게 무릎을 꿇고 사과할 것을 요구하고, 웃옷을 벗어 전신 문신으로 위협을 함에도 피해자 E가 무릎을 꿇지 않자, 화가 나 주먹으로 피해자 E의 얼굴을 수회 때려 피해자 E를 기절시키고, 피해자 E의 일행인 피해자 F(47 세) 이 피고인을 말린다는 이유로, 주먹으로 피해자 F의 얼굴을 수회 때리고 머리로 피해자 F의 머리를 2회 들이받고, 두려움에 무릎을 꿇은 피해자 F의 얼굴을 발로 2회 걷어찼다.

이로써 피고인은 피해자 E에게 약 3 주간의 치료가 필요한 우측 안와 부위 멍듦 타 박상 등을 가하고, 피해자 F에게 약 2 주간의 치료가 필요한 우측 눈썹 부위 열상 등을 가하였다.
