A defendant shall be punished by imprisonment for six months.
except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
The defendant is the chief secretary of the "D Office" in Bupyeong-gu Incheon Metropolitan City.
Around March 2009, the defendant entered into an agreement with the victim E forestry cooperatives and real estate collateral loan business with the above certified judicial scrivener office, and made it possible to deliver the loan documents to the victim and to execute registration affairs on behalf of the victim.
1. A real estate loan in the name of the F;
A. A. On May 14, 2009, the Defendant forged private documents: (a) on the file of “detailed assessment” with respect to “Silmon Credit Information Company 2” sent by using computers installed at the place in the said certified judicial scrivener office; (b) from “7,000, the amount in the current market value column” to “10,000; and (c) at the present city of the Si Investigation Office 1, the “500-7,000” to “9,500-10,000” to “9,50-7,000” to “5,500-7,000” to “9,500-10,000” to “the market value of the pertinent goods” to “the market value is presumed to be KRW 100,000,000; and (d) on-site opinions not written in the public column to “the pertinent goods” to arbitrarily output the contents as above.
Accordingly, the Defendant forged the solomon credit information statement in the name of Solomon credit information for the purpose of exercising a certificate of fact.
B. Around May 2009, the Defendant sent a forged market price appraisal report to the victim association by mail as if it were a document duly formed at the above certified judicial scrivener office.
C. The Defendant in breach of trust, at the same time and place as in the preceding paragraph, deals with the business of confirming the market price of “Incheon-dong Gagra 2, Nam-gu Gag-gu Gagwon,” a security for real estate loan through solomon credit information on behalf of the victim association, and then, in violation of the duty to deliver accurate market price verification results, provides a false market price appraisal statement prepared by breaking the market price so as to prevent the victim from properly evaluating the market price of the security.
