The prosecution of this case is dismissed.
Reasons
1. On November 17, 2013, the Defendant: (a) committed assault by freshing the epina in a 7th floor of the “Dratium” located in Osan City, Osan-si; (b) on the 7th floor of the 17th floor of the 2013, the victim E was freshing with fresh.
2. The facts charged in the instant case are crimes falling under Article 260(1) of the Criminal Act and cannot be prosecuted against the victim’s express intent under Article 260(3) of the Criminal Act. The victim E can be acknowledged to have withdrawn his/her wish to punish the Defendant as a witness at this court on November 19, 2014. Thus, the instant indictment is dismissed in accordance with Article 327(6) of the Criminal Procedure Act.
