피고인은 2013. 11. 22. 11:20경 서울 강북구 B 앞 노상에서 112신고를 받고 출동한 C파출소 경장 D이 술에 취해 지나가는 40대 여성의 몸을 밀치며 시비를 하고 있는 피고인을 보고 귀가를 종용하자 피고인은 "니가 뭔데 참견이냐. 이 씨발새끼야! 야 이 씨벌새끼야. 개새끼야. 들이 대봐, 이 씹새끼야. 너는 내가 가만히 안둬. 그래. 내가 욕했다. 이 씨발새끼야. 뭐 어떻게 할 껀데 이 씹새끼야."라고 욕설을 하는 등 동소 빌딩 주차관리인 E 등 시민들이 보는 가운데 욕설하는 등 공연히 모욕하였다.
