(2) Articles 208(3)1 and 257(1) of the Civil Procedure Act apply mutatis mutandis to the following cases: (a) the Plaintiff, “Plaintiff, C, and D acquired E’s shares by partition of co-owned property; and (b) the Plaintiff, as a preservation act based on co-owned shares, sought implementation of the procedure for cancellation of registration of establishment of a mortgage in the name of the Defendant.
