1. The Defendant (Counterclaim Plaintiff) and the Defendant jointly and severally file for KRW 70,000,000 with the Plaintiff (Counterclaim Defendant) on January 27, 2011.

Reasons

1. Basic facts

A. The plaintiff is a company aimed at the formulation and design of the national land plan. The defendant company is a company aimed at the overall processing of livestock products, etc., and the defendant is a de facto manager C (one name name D) who is a de facto manager of the defendant company.

B. On March 19, 2009, the Defendant Company concluded a service contract with the Plaintiff with the following contents (hereinafter “instant service contract”), and paid KRW 30,000,000 out of the down payment to the Plaintiff on the same day. The Defendant jointly guaranteed the Defendant Company’s obligation to pay the price.

General terms of contract: E slaughterhouse urban management plan and contract amount: daily twenty million won (150,000,000) - Additional tax Map Article 2 (Contents of Business) conducted by the Plaintiff shall be as follows:

(1) The urban management planning 1-type 40,000,000, the 1-type 15,000,000, the 1-type 15,000,000, the 1-type 1-type 15,000,000, the environmental review-type 1-type 1-type 65,000,000, the 1-type 1-type 65,000,00 cadastral boundary (including a survey) for civil engineering design (including a survey) for the purpose of civil engineering design (including a survey), such as the increase in the area of land, farmland, mountainous district damage charges, and all kinds of authorization and permission, shall be paid within the extent of consultation between the defendant company and the plaintiff.

(1) 30% when a contract is concluded, 50% upon receipt, and 20% upon completion.

C. On June 8, 2009, the Plaintiff received a resident proposal related to the determination of the E slaughterhouse management plan (hereinafter “instant proposal”) in the name of the Defendant Company to the Korea Development Agency, which is the competent authority, in accordance with the instant service contract. After deliberation by the Development and Planning Committee, the head of the Development and Development Gun, after October 15, 2009, shall make the said proposal a conditional farmland and border area forest zone formation, shielding water installation, and preserving mountain ridges at national highways and connection points.
