On November 27, 2014, the Chapter C of the National Democratic Union Trade Union reported the assembly to the Net Police Station on November 24, 2014 in the name of organizer E in order to hold a “D” assembly from around 00:00 to December 24:00.

피고인은 F 08:20경 순천시 장명로 30 순천시청 현관 앞에서, E가 위와 같이 신고한 집회를 개최하기 위하여 G 카니발 승합차에 설치되어 있는 스피커를 이용하여 ‘노동가’를 틀어놓고 피켓이 바람에 날리지 않도록 끈으로 묶는 등 집회 준비를 하고 있는 것을 발견하고, E에게 “뭣 때문에 시끄럽게 음악을 틀어놓고 집회를 하느냐.”라고 말하며 스피커를 끄고, “니가 민주노총이냐.”라고 소리를 지르면서 위 승합차 문을 열고 그 안에 있던 행사준비용 쇠망치를 꺼내어 오른손에 들고 E를 때릴 것처럼 쫓아다니고, 위 승합차 조수석에 있던 마이크를 꺼내 밖으로 던져 폭행 등으로 위 집회를 방해하였다.
