Based on its stated reasoning, the lower court upheld the conclusion of innocence of the first instance court on the grounds that there was no proof of the facts charged in the instant case.

Examining the records in light of the relevant legal principles, the above judgment of the court below is just and acceptable.

In so doing, contrary to the allegations in the grounds of appeal, there is no error of law by misunderstanding facts in violation of logical and empirical rules or by misapprehending the legal principles.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
