Of the facts charged in the instant case.

1. No person who violates the Act on the Promotion of Utilization of Information and Communications Network and Protection, etc. of Information shall intrude into an information and communications network without legitimate access authority, and shall infringe, misappropriate, or divulge another person's confidential information processed, stored, or transmitted through the information and communications network;

Nevertheless, the Defendant, who is connected to the Internet by wire or wireless means, used the “IP camera” that can immediately transmit images using devices such as PC, mobile, smartphones, etc., to steals another’s privacy, body, etc.

On April 19, 2017, the Defendant: (a) accessed the Defendant’s house located in Guro-gu Seoul Metropolitan Government D, 107 Dong 1205 to the Internet using the PC, and (b) automatically searched the IP where the “IPM” is installed and the Pool program “F in Kim Sea-si, Kim Sea-si,” “IPM,” which was installed by F in the clothing store operated by F in the commercial building E, and the manager’s web page, without any legitimate authority to access the “IPM” and the “G” and the initial password from around 107 to 4:17:4 on April 17, 2017, the Defendant did not intrude the Defendant’s house and password to the 200-day web page without legitimate authority to access the information and communications network; and (b) did not intrude the Defendant’s 1 to 4:7 on April 217, 2017.
