1. The defendant paid KRW 49,765,170 to the plaintiff and 5% per annum from June 9, 2005 to June 27, 2007.
Reasons
1. On July 18, 2007, the Plaintiff filed a claim for reimbursement against the Defendant, and was sentenced to the Seoul Central District Court Decision 2007Da10803, which became final and conclusive around that time.
The lawsuit of this case shall be filed to extend the prescription period according to multi-oms when the extinctive prescription of the above judgment bond expires.
2. Judgment by service (Article 208 (3) 3 of the Civil Procedure Act).
