The prosecutor's appeal is dismissed.
Reasons
The prosecutor appealed too somewhat less than 6 million won in the sentence of the court below (the penalty amount of 6 million won).
However, in full view of the various sentencing conditions in the records and arguments of this case, including the fact that there is no change in the sentencing conditions compared with the original judgment, and the defendant had been committed three times the same criminal convictions, while both the defendant was punished by a fine in 2013, the lower court’s sentencing is not recognized to be unfair.
Therefore, the prosecutor's appeal is dismissed.
