지적재조사지구 경계결정 이의신청 기각결정 취소
1. On March 19, 2018, the Defendant rendered a decision to dismiss an objection to the boundary determination of the cadastral resurvey district to the Plaintiffs.
1. Nonparty E is the owner of land of 846 square meters in F forest land in Gyeyang-si, Yangsan-si (hereinafter “instant land”); and the Plaintiffs are the persons holding superficies of the instant land.
B. The Defendant is a project implementer of a cadastral resurvey project district (hereinafter “instant project district”) under the Special Act on Cadastral Resurvey (hereinafter “Cadastral”) and the instant land is assigned to the instant project district.
다. 피고는 2017. 9. 21. 원고들에게, 지적재조사법 제15조 제3항에 따라 이 사건 사업지구에 대한 지적확정예정조서를 작성하여 통지하였는데, 위 조서에 따르면 이 사건 토지의 면적은 226㎡가 감소(846㎡ ☞ 620㎡)된다.
On September 29, 2017, the Plaintiffs presented an opinion to the Defendant that “The Plaintiffs oppose the decrease in the area of the instant land. They keep the land as a boundary registered in the cadastral map and request it to be maintained.”
피고는 2017. 12. 1. 원고들에게, 별지1 지적재조사 경계결정 통지서 기재와 같이 이 사건 토지의 경계를 새로 결정(이하 ‘이 사건 경계결정’이라 한다)한 후 같은 달 11. 원고들에게 이를 통지하였는데, 위 결정에 의하면 이 사건 토지의 면적은 107.8㎡가 감소(846㎡ ☞ 738.2㎡)된다.
E. On January 18, 2018, the Plaintiffs filed an objection against the instant boundary determination with the Defendant on the ground that “the Plaintiff was a building constructed without permission on the instant land, not a boundary adjustment due to cadastral inconsistency.” However, the Defendant dismissed the said objection on March 19, 2018 (hereinafter “instant disposition”) following the deliberation by the Yangsan City Boundary Determination Committee.
F. On May 14, 2018, the Plaintiffs filed an appeal seeking the revocation of the instant disposition with the Gyeonggi-do Administrative Appeals Commission, but the said commission dismissed the said claim on June 27, 2018.
