1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
1. Basic facts
A. The Plaintiff is a council of occupants’ representatives comprised of the occupants of Gyeonggi-gu A Apartment (hereinafter “instant apartment”).
The above apartment complex consists of 180 households, and the council of occupants' representatives shall elect one representative from 1, 3, and 4 persons from 1, 2 Ra to 1, 3, and 4 persons, and consist of 6 (3 units) persons.
B. C, who was the chairperson of the Plaintiff, resigned from the office of president on January 2012, and D, was elected as the latter president on June 11, 2012, but the president became vacant.
At the time, the number of members of the council of occupants' representatives was three, but the defendant B was appointed as the Chairperson's acting as the Chairperson with their consent.
C. Around June 2012, the instant apartment complex was previously operated as an autonomous management. Around June 2012, the Plaintiff’s council of occupants’ representatives resolved to change the management method from the autonomous management to the entrusted management, and on June 13, 2012, Defendant B entered into an entrustment management contract with the Korea Industrial Development Co., Ltd. (hereinafter “Nonindicted Company”) that was selected as an entrusted management company on behalf of the Plaintiff and as an entrusted management company.
The chairperson of the apartment election management of this case (former representative E) and the election management members were dismissed on July 2012, and thereafter, the new appointment of the election management members of the apartment of this case was made from the election management commission to the election management committee on February 1, 2013, and the chairman of the election management commission appointed F as the chairperson of the election management committee. On February 4, 2013, the above election management committee chairperson announced the public announcement of the special election of each apartment of this case on February 4, 2013, the representatives of two constituencys were elected from the above presidential election, and the council of occupants' representatives consisting of the representatives of the two buildings, including the representatives of two buildings appointed as the above special election, held on February 26, 2013 and
E. E filed an application against Defendant B for the provisional disposition of suspending the execution of duties with the District Court 2013Kahap69, and the said court on June 5, 2013 shall set forth in the instant apartment management rules.
