1. As to the portion of 3/11 square meters in the F 509 square meters in Nam-si, Namwon-si, the Defendant is among the above real estate to the Plaintiff B, C, D, and E.
1. Determination as to the cause of claim
A. 1) The fact of recognition is 509 square meters in Namwon-si, Namwon-si (hereinafter “instant land”).
On December 28, 1970, the registration of ownership transfer was completed under the Defendant’s name. 2) On the other hand, around 1930 on the ground of the instant land, the registration of ownership transfer was completed in H and I’s name on August 11, 1972.
3) The network G (hereinafter “the network”) is referred to as “the network”).
A) On March 6, 1982, the sales contract (Evidence A7) prepared at the time all the instant housing and the instant land from H stated “F building and site size” as the subject matter of sale and purchase. The area of the said site is consistent with the size of the instant land. The purchase price of KRW 2.5 million was completed on April 7, 1982, and the deceased died on July 20, 2001, and its heir was the Plaintiff B, C, D, and E, the children of the deceased, who were the wife of the deceased.

B. According to the above facts of recognition, the deceased continuously occupied the instant land corresponding to the site of the instant house from April 7, 1982, as the purchaser of the instant land and building, which completed the registration of ownership transfer as to the instant building, from around April 7, 1982, and the above possession of the deceased shall be deemed to have succeeded to it by the Plaintiffs, who are the inheritor of the deceased, after the death of the deceased. Therefore, unless there are special circumstances, the defendant shall take the procedure for the registration of transfer of ownership based on the completion of the prescription for possession of 2/11 shares of each of the land in this case to the plaintiff Eul, Eul, D, and E with respect to the share of 3/11 of the land in this case according to the plaintiffs' share of inheritance.
