The judgment on the primary argument of the plaintiffs
가. 원고들의 주위적 주장에 관한 판단 1) 살피건대, 갑 제1370 내지 1375, 1377호증, 을가 제1호증(가지번호 포함)의 각 기재 및 영상, 제1심 법원의 당진시장에 대한 2013. 12. 17.자 사실조회결과와 변론 전체의 취지에 의하면, 아래와 같은 사실이 인정된다. 가) 이 사건 사고 이후 당진 관내의 기름 유출 및 방제 내역으로, ① 2008. 2. 1. 12:50경 당진시 석문면 장고항리 용무치 포구와 선착장 주변의 좌우 500m 범위에서 타르가 부분적으로 자갈과 모래에 부착됨에 따라 10명이 10kg 의 타르를 수거하였고, ② 2008. 2. 28. 15:00경 당진시 석문면 난지도리 대난지도 해수욕장에 손톱 크기의 타르가 1km × 1m 정도로 분포되어 6명이 1kg 의 타르를 수거하였으며, ③ 2008. 3. 5. 14:15경 안산시 육도(미륵도) 남서방 0.8마일 해상에 위치한 길이 500m, 폭 200m의 해역에서 2∽3cm 크기(500원 짜리 동전 크기)의 타르가 띠 형태로 발견되고 유막이 흘러다니고 있음이 확인되어 해경 함정 등이 스크류 와류를 이용하여 방산시킨 적이 있었고, ④ 2008. 3. 5. 16:00경에는 당진시 석문면 난지도리 대난지도 해수욕장에 1∼3cm 크기의 타르가 1m × 20m 정도로 분포되어 6명이 1kg 의 타르를 수거하였다.
