A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Punishment of the crime
1. No person who violates the Act on the Protection of Children and Juveniles against Sexual Abuse (production, distribution, etc. of obscene materials) shall distribute, provide, openly exhibit or screen obscene materials for children or juveniles;
On September 11, 2018, at the defendant's house located in Gwangju Northern-gu B and 3, the defendant sent a child or juvenile pornography under item (i) of this paragraph using the defendant's computer, and then posted a child or juvenile pornography under item (ii) of this item (i) using "Adi" D, "E," indicating the place in which female juveniles who suffered school uniforms and men engage in sexual intercourse, by using the defendant's computer.
In addition, from May 7, 2018 to September 11, 2018, the Defendant posted 9 obscene materials for children and juveniles on each of the above Internet sites as indicated in attached Table 1 to 9 attached hereto, as shown in attached Table 1 to 1 of the sight of crimes, and distributed them to many and unspecified persons.
2. No person who violates the Act on the Protection of Children and Juveniles against Sexual Abuse shall distribute, openly exhibit, or knowingly possess obscene materials for children or juveniles;
On April 30, 2016, the Defendant, at the Defendant’s house located in Gwangju North-guJ, received a video file “K” indicating the scene of sexual intercourse between female juveniles and men, using the Defendant’s computer, and was in possession of the Defendant’s external cover, and went through a total of 15 children and juveniles pornography from June 2, 2018 to June 2, 2018.
3. No person who violates the Act on the Promotion of Utilization of Information and Communications Network and Information Protection, etc. (Distribution of obscene materials) shall distribute, sell, lease, or openly exhibit any obscene codes, text, sound, image, or motion picture through an information and communications network;
