A. Defendant A may not take over the means of access in using and managing the means of access. Defendant A is a person who naturalization from his arms to Korea. The Defendant provided a list of foreigners to D and E who is a foreign prepaid agent by avoiding surveillance at the workplace while serving as a four-use interpreter. In return, the Defendant had expressed mind on March 16, 2017 to use the passbook in the name of son as a borrowed account in order to receive fees of KRW 10,000 won per opening. A) on March 16, 2017, the Defendant offered that the Defendant, around March 16, 2017, opened an account with the F building in Seoul Special Metropolitan City, Nowon-gu, and the Defendant’s dwelling in the name of the Defendant, and sent that passbook, cash card, etc. to the Defendant. Accordingly, the Defendant acquired the means of access through H (I) account in the name of the Seocho branch in Busan Metropolitan City on March 16, 2017.

B) On August 23, 2018, the Defendant, at the Defendant’s residence on August 23, 2018, acquired eck cards connected to B’s account (K) in the name of the J bank (K) established at the Busan J Bank Port on August 23, 2018.

Accordingly, the Defendant acquired the means of access in another’s name.

2) In using and managing the means of access for electronic financial transactions, Defendant B is prohibited from transferring the means of access unless otherwise specifically provided for in other Acts. Nevertheless, around March 16, 2017, the Defendant, his father, “A requires a passbook and a e-mail card. I create an account in the name of four and send it to door-to-door.” On the same day, the Defendant’s H bank account in the name of the Defendant (one passbook opened and one e-mail card connected to the said account, and one e-mail card sent to A at home, and then sent the password to A, and then communicate again with A around August 23, 2018.
