1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
On November 9, 2009, the Plaintiff lent KRW 42,642,124 to the Defendant with interest rate of 25% per annum. Since interest calculated as of July 10, 2017 is KRW 81,730,737, the Defendant is obligated to pay the Plaintiff a loan of KRW 124,372,861 (= KRW 42,642,124 KRW 81,730,737) and damages for delay.
The Plaintiff’s loan is not sufficient to recognize solely on the basis of the evidence No. 1, and there is no other evidence to acknowledge it.
Therefore, the plaintiff's claim of this case is dismissed as it is without merit, and it is so decided as per Disposition.
