1. The defendant shall pay to the plaintiff KRW 70,000,000 as well as 12% per annum from February 5, 2020 to the day of complete payment.
In full view of the purport of the argument in Gap evidence No. 1, the defendant is obligated to pay to the plaintiff 70,000,000 won paid by the plaintiff as investment by November 30, 2012 between the plaintiff and the plaintiff on May 29, 2012. Thus, the defendant is obligated to pay to the plaintiff 70,000,000 won and the amount of delayed damages calculated at the rate of 12% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from February 5, 2020 to the day of full payment after the day of delivery of the original copy of the payment order in this case.
Therefore, the claim of this case is justified, and it is so decided as per Disposition.
