A. The defendant brought a lawsuit against the plaintiff as the court 2008 Ghana28148, and as a result, the defendant won the lawsuit on December 17, 2008, which became final and conclusive around that time.

B. Based on the above final judgment, the Defendant failed to apply for a compulsory auction against the Plaintiff’s real estate to the Gunsan Branch B, and on January 27, 2015, the Plaintiff repaid KRW 17,794,254 to the Defendant with the principal and interest obligation under the above judgment.

2. According to the above facts, the defendant's claim against the plaintiff was extinguished by the plaintiff's repayment as above.

3. In conclusion, the plaintiff's claim of this case seeking the exclusion of executory power of the above final judgment is reasonable, and it is so decided as per Disposition.
