The prosecution of this case is dismissed.
1. At around 15:30 on March 27, 2019, the Defendant: (a) observed a dry field located in Soyang-gu, Soyang-gu; (b) the victim C (60 years of age) was engaged in a flating work in the dry field as a scamblinger with a scamblinger; (c) took the scambling dispute with the victim; and (d) assaulted the victim by making a scambling the victim’s face one time with a hand, scam and scambling the victim’s scam.
2. The facts charged in the instant case are crimes falling under Article 260(1) of the Criminal Act, which cannot be prosecuted against the victim’s express intent under Article 260(3) of the Criminal Act. Since the victim expressed his/her intention not to punish the defendant on October 25, 2019, the prosecution against the facts charged in the instant case is dismissed pursuant to Article 327 subparag. 6 of the Criminal Procedure Act.
