계약해제반환금 청구의 소
1.(a)
Defendant D and E Co., Ltd. are jointly and severally liable for 48,720,000 won for Plaintiff A and 43,720,000 won for Plaintiff B.
1. The description of the grounds for the claim shall be as specified in the attached Form;
2. Judgment on deemed confession based on recognition (Articles 208 (3) 2 and 150 (3) of the Civil Procedure Act);
3. According to the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings (amended by Presidential Decree No. 29768, May 21, 2019), the statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings is 12% per annum from June 1, 2019. Thus, the part of the claim for damages for delay seeking payment exceeding the rate of 12% per annum from August 29, 2019 is rejected.
