For the reasons indicated in its reasoning, the lower court upheld the first instance judgment that acquitted the Defendant on the charge of this case on the ground that there is no proof of crime.

In light of the records, the above judgment of the court below is just, and it did not err by exceeding the bounds of the principle of free evaluation in violation of logical and empirical rules, or by misapprehending the legal principles on trade secrets or major business assets, and intentional breach of trust in the course of occupational duties, without failing to exhaust all necessary deliberations as alleged in the grounds of appeal
