The judgment below

In light of the records, the court below reversed the judgment of the court of first instance which found the defendant guilty on the grounds that there is no proof of crime as to the facts charged (excluding the part concerning the charge) of this case, and found the defendant not guilty on the grounds as stated in its reasoning is justifiable in accordance with the purport of the judgment of remand. In so doing, contrary to the allegations in the grounds of appeal,

On the other hand, the prosecutor appealed against the guilty portion of the judgment of the court below, but does not state the grounds for objection to this portion in the petition of appeal and appellate brief.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
