1. As to KRW 45,918,097 and its KRW 9,326,655 among the Plaintiff, the Defendant shall start from December 20, 2018 to October 24, 2019.
1. Indication of claims: It shall be as shown in attached Form; and
2. Applicable provisions of Acts: Article 208 (3) 3 of the Civil Procedure Act (Judgment by public notice);
3. Partial dismissal.
(a)the total cost of KRW 199,958 out of the claimed amount will be dismissed due to lack of evidence;
The loan principal amounting to KRW 9,326,655 does not recognize damages for delay of 24% per annum for which the Plaintiff seeks due to lack of evidence against overdue interest rates, but recognize damages for delay calculated at the rate of 6.9% per annum, the agreed interest rate until October 24, 2019, and the rate of 12% per annum under the Act on Special Cases concerning Expedition, etc. of Legal Proceedings, from October 25, 2019 to the date of full payment (the damages for delay incurred before December 20, 2018 shall be reflected in the total amount of principal and interest in KRW 45,918,097).
