1. The defendant shall pay 59,250,000 won to the plaintiff and 20% per annum from March 15, 2019 to the day of complete payment.
1. The Plaintiff, who indicated the claim, provides labor under employment by the Defendant from February 1, 2017 to February 28, 2019.
Although the Defendant retired from the office, the Defendant does not pay the Plaintiff’s wage of KRW 52,250,000, retirement allowance of KRW 7,000,000, total of KRW 59,250,000, and KRW 59,250,000 from the date of retirement without any agreement on the extension of the payment date. As such, the Defendant is claiming damages for delay at the rate of 20% per annum under Article 37(1) of the Labor Standards Act and Article 17 of the Enforcement Decree of the same Act from the date following the retirement date to the date of complete payment.
