1. 피해자 B에 대한 상해 피고인은 2013. 8. 10. 01:20경 광주 북구 C에 있는 D주점 앞 도로에서, 피해자 B(43세)이 운전하는 E 택시의 조수석에 승차해 있던 중, 같은 구에 있는 광주북구청 앞 도로를 지날 때 피해자에게 적색신호를 무시하고 진행하라는 요구를 하였음에도 피해자로부터 거절당하였다는 이유로 화가 나, 피해자에게 “씹할 놈아, 나의 말을 무시하냐”라고 소리치고, 주먹으로 피해자의 오른쪽 눈 부분을 1회 때리고, 한 손으로 피해자의 옷을 잡은 후 다른 주먹으로 피해자의 얼굴과 머리 부분을 수회 때리고, 그곳 콘솔박스 위에 놓여있던 피해자의 휴대폰을 들고 피해자의 머리 부분을 수회 때리고, 주먹으로 피해자의 안면을 수회 때리다가, 때마침 위 택시에 승차하려던 F, G으로부터 제지당하자 잠시 위 택시에서 하차하였다가 다시금 위 택시 조수석의 문을 열고 발로 피해자의 몸을 2회 찼다.
